Man Sentenced to 7 Years after DUI Death

In our neighboring state of Arizona, a seven-year prison sentence was just imposed for an AZ resident who caused a fatal crash after driving under the influence of alcohol. The man convicted of manslaughter and DUI charges was Joseph Richard Baird of Golden Valley Arizona. He had been driving on a state highway when he turned in front of an oncoming motorcycle. The man riding the motorcycle was critically injured as a result of the collision, and he eventually died of his injuries at a Las Vegas hospital five days later. Las Vegas Law Enforcement is being accused of being “money hungry” when it comes to its approach to misdemeanor warrants.

Las Vegas Law Enforcement is being accused of being “money hungry” when it comes to its approach to misdemeanor warrants.

Critics claim that the collect-at-all-costs mentality places a high emphasis on traffic ticket revenue and is most likely to hurt minority defendants who fail to pay speeding tickets, while leaving more serious offenders roaming the streets. Former Las Vegas Marshal Richard Kilgore said the court rewards officers who bring in the most money and offers additional training and promotions to marshals who “negotiate court-ordered bail amounts with scofflaws in the field.” Those who do not, he said, find themselves out of luck. “Officers like myself would get denied training, get stuck in court more,” Kilgore added. “That’s where I thought (marshals) were supposed to be. I’ve always thought that we’re not there to generate revenue, we’re there to enforce court orders and uphold the decorum of the court.” Another critic, Court Administrator Dana Hlavac, added, “I’m not going to force people to pay money they can’t pay just so we can keep running our business,” he added. Records obtained by the Las Vegas Review-Journal via Nevada’s public records law display that the Las Vegas Municipal Court collected nearly $130 million — 89 percent of its total revenue — from traffic violations over the past five years. The majority of that was taken in by speeding tickets or other moving violations.   Do you have a Las Vegas Traffic Ticket you would like reduced to no points, no school, no traffic school?  Call today for a Free Consultation at (702)...

Las Vegas DUI – Man kills woman and her granddaughter at bus stop

This past Monday, a Las Vegas woman and her young granddaughter were tragically killed in a hit-and-run incident while they waited at a bus stop. The woman has been identified as Maria Garcia, age 58. Her granddaughter, Alyssa, was just six years old. Both died from injuries at University Medical Center. Police believe the man responsible for the fatal crash is 20 year old Leonardo Ruesga. Ruesga was detained and booked in Clark County Detention Center where he faces charges included two counts of DUIs as well as a charge for leaving the scene of a car crash. Police also reported that an 18 month old little girl was injured in the car crash. The car crash itself occurred near Maryland Parkway and Sahara around 2:30 p.m. when a 2005 Volvo driven by Ruesga drove onto the sidewalk. At first, according to witnesses, the Volvo hit a stroller carrying the 18 month old girl. Then Maria and Alyssa were hit. Police reported that Ruesga and his teenage daughter (who was a passenger in his car) were hiding at an apartment complex near the scene of the crime when they were discovered. Ruesga openly admitted to police that he had been drinking and doing illegal substances before he was booked in Country. Don’t let a DUI ruin your life. Jaywalking in Las Vegas

Pedestrians continue to be killed on Las Vegas roadways as careless drivers fail to slow down or stop when un-shielded men and women are crossing the street and “in their way.” In 2014 alone, The Associated Press reported that 284 people lost their lives on Nevada roads, which is higher than the previous year, but not as dramatic as the horrid high of 423 driving-related deaths in Nevada in 2006. Officials attempt to remedy this morbid problem with a heavier police presence to ticket the drivers– but many individuals also see the pedestrians as at fault, due to the fact that in many circumstances they are jaywalking or distracted (on their cell phones talking or texting, listening to music, walking while intoxicated, etc.) A jaywalking ticket can range upwards of $200 here in Las Vegas– and many officials believe that issuing tickets to both the pedestrians and the drivers may be a way to help remedy this problem faster. Whatever becomes of the situation– do be careful when driving (or walking!) on a Las Vegas roadway. And if you or someone you know has been issued a Ticket in Las Vegas for jaywalking, or any other Traffic-related incident, contact our office to avoid further stress in this matter. In most cases, we can have your ticket reduced to No Points, No School, and No Waiting in Line at Court. Give us a call at (702) 382-2000...

New Bill = Increased Speeding Ticket Fines

You may know from experience: the surest way for a Las Vegas Metro Officer to get you to slow down is to hit you with a huge fine. This is the current strategy here in the Valley, as a new bill is rapidly moving through the Nevada Legislature that would raise the fine on speeding tickets received in pedestrian zones. Currently, driving up to 10 miles per hour over the posted limit at a regular Las Vegas intersection will cost you around $148. If the new bill passes, certain intersections would be deemed “pedestrian zones” and the speeding tickets would cost $200 or as much as $450, depending on your speed. Fox 5 reported Erin Breen–coordinator of UNLV’s Traffice Safety Coalition– as having stated, “We’re having a terrible year. We’re up to 12 fatalities in Clark County already.” The new law wold also make passing other vehicles in a school zone illegal. While all this continues to run through the legislative pipelines, another bill is being sponsored that would increase fines for hit-and-run drivers. Las Vegas DUI Checkpoints for Super Bowl Weekend

Las Vegas DUI Checkpoints for Super Bowl Weekend As with all major holidays in the Valley, Las Vegas police plan to do their best to deter drunk drivers from inflicting damage upon themselves and other motorists on the roadways. Super Bowl Sunday is one of the biggest social partying events of the year; therefore, Las Vegas police have announced a necessary “Sobriety Checkpoint” on Super Bowl Sunday at the intersection of Blue Diamond Road and Decatur Boulevard. The checkpoint’s intention is the identify drivers under the influence of drugs or alcohol, so that they may be removed from the road. The checkpoint will be operating from 6 p.m. until 1 a.m. according to the police. This initiative is being set in motion through the cooperation of Nevada Highway Patrol, Boulder City police, and deputies from Lincoln and Nye counties. It is part of a federally-funded campaign called the “Joined Forces Campaign” which was funded 1.5 million dollars in order to help reduce DUIs, speeding, and cell phone useage. Also to note: this may not be the only Sobriety Checkpoint in the Las Vegas Valley this upcoming weekend. Oftentimes, there are multiple checkpoints scattered across the Valley during any given holiday. Former Henderson Police Officer Driving Wrong Way on the 95

Former Henderson Police Officer Driving Wrong Way on the 95 While off duty, 31-year old former Henderson Police Officer, Joseph Lawrance, led Highway Patrol officers on a speedy chase recently when he was seen driving the wrong way on U.S. Highway 95 near Durango. As officers chased Lawrance attempting to pull him over, Lawrance also drove the wrong way on additional surfact streets, as well as blew through a red light, according to prosecutors. Results of the blood test taken by Lawrance revealed that his blood alcohol level was 0.185 percent, which is over twice the legal limit to drive. Lawrance pleaded no contest to a DUI, though according to his attorney, Josh Tomscheck, he does play to plead guilty to the felony charge of eluding police. In the meantime, Lawrance has been ordered not to drink and must wear a device that monitors whether or not he uses alcohol. Lawrance must additionally undergo at least one year of alcohol treatment supervised by Las Vegas courts. If he completes the program, he will be allowed to withdraw his plea to the felony, having it reduced to a misdemeanor. Also to note: highway troopers found a loaded gun and hundreds of prescription pills inside Lawrance’s Toyota, along with a bottle of opened whiskey. The Las Vegas Review Journal Reports that Lawrance “believes he has a problem with alcohol, and I believe that’s the only explanation for what happened in this case,” Tomsheck said. “There’s no other way to describe this than an aberration.” Do you have a DUI charge in Las Vegas or Henderson?
